1. What you can buy
Under India's foreign exchange rules (FEMA), NRIs and OCIs can generally buy residential and commercial property. Agricultural land, plantation property and farmhouses are generally not permitted unless inherited. Always confirm current rules with a professional.
2. Paying for the property
- Payments are typically made through normal banking channels — inward remittance or funds in your NRE / NRO / FCNR accounts in India.
- Keep records of every payment for future repatriation and tax purposes.
3. Home loans
Many Indian banks offer home loans to NRIs. Eligibility, documentation and rates vary by bank — try our EMI Calculator for an early estimate.
4. Power of attorney
If you can't be present, you can authorise a trusted person through a power of attorney, which typically needs to be executed and attested as per Indian requirements. A lawyer can advise on the correct format.
5. Due diligence from abroad
- Follow every check in our Buyer's Guide.
- Ask us for video walk-throughs and document copies on WhatsApp.
- Engage an independent local lawyer for title verification.
6. Tax
Rental income and capital gains from Indian property are taxable in India, and TDS rules apply when buying from or selling as an NRI. Consult a chartered accountant.
This guide is general information to help you prepare. It is not legal, tax or financial advice. Rules and rates change — please confirm current requirements with a qualified lawyer or chartered accountant before acting.
